Rural Law and Farm Transactions.

A number of the people that make up our agribusiness team either come from farming backgrounds or have extensive experience in advising farming clients.  Downie Stewart prides itself on a personal service and it is not unusual for our partners to travel out to our clients to see them on their properties.

  • Our team of advisors have many years of experience in family succession structures and plans. We are well placed to help you and your family move on to the next generation. We work closely with your other advisors to formulate a family succession plan and then implement that plan.

  • We have a range of experts in this area to help you with all types of farming transactions including buying, selling or leasing property or grazing livestock and complicated lending structures.

We pride ourselves on our communication and keeping our agreements as simple and practical as possible in order to tailor these to your needs and expectations.

  • We are experienced in not only acting for borrowers but also acting for lenders in relation to taking security over farm assets. To this end, we also have expertise in relation to Farm Debt Mediation and the enforcement of securities generally.

  • Our employment team advises a number and wide range of businesses including farming clients. In addition, we have experience in dealing with independent contractor agreements including sharemilking contracts.

  • We have an appreciation for the necessity to ensure that there is a viable and consistent source of water for any farming operation. Whether it be through an irrigation company or through water permits, we are able to assist in relation to ensuring that these are in place for any farm purchase or to apply for such water rights as may be necessary/possible to obtain, either for stock or irrigation needs.

  • Farm debt mediation is a relatively new concept in New Zealand and the all-encompassing breadth of the legislation is often surprising for clients. We have represented several clients in the farm debt mediation sphere including the entry into settlement agreements as a result of that mediation.

  • Our property team are experienced in assisting clients with both subdivisions of a simple and complex nature as well as boundary adjustments between neighbours in rural settings. We work together with planners and surveyors to try to make the process as seamless and efficient as possible.

  • We have experience in putting in place both simple and complex forestry rights and dealing with the other agreements that sit behind them. We also have access to external consultants who can help with any emissions trading scheme (ETS) registration and issues that may arise.

  • The emergence of solar farm opportunities in New Zealand is growing with interest from companies looking to invest in New Zealand from overseas and locally. We have helped local farming clients with navigating their way through various agreements including options to lease, lease agreements, some purchase agreements and easements either with the network operator or Transpower.
