Building Law

Building disputes are unfortunately all too common. Unclear or changing specifications, different expectations of the parties, poor quality materials or just plain poor workmanship can all cause problems. The leaky homes debacle is an unfortunate nationwide example.

Construction is an expensive activity with a lot at stake and the possibility of one or more parties being dissatisfied is significant.

The Constructions Contracts Act 2002 and the Weathertight Homes Resolution Service Act 2006 provide clear processes that can be used to resolve many disputes.

Downie Stewart has broad experience in this area of the law and understands building issues. We have acted for both builders and clients over many years in a range of disputes and have extensive practical experience of mediation, arbitration and litigation as resolution mechanisms.
